1. Medical disclaimer

1.1 Not a medical device

AsthmaCare is an information and documentation app and is not a certified medical device within the meaning of the Medical Devices Act (MPG). The app is intended solely for:

Documenting symptoms
Monitoring the course of asthma
Providing information about environmental factors (weather, pollen, air quality)
Supporting communication between parents and children

1.2 No medical advice

The information, risk assessments, and recommendations provided in the app do not replace professional advice from a doctor, pharmacist, or other qualified healthcare provider.

Please note:

Always consult a doctor if you have any health questions
Never change your medication without consulting your doctor
Do not rely solely on the app data
The app may contain errors or misinterpret symptoms

In case of acute breathing difficulties or emergencies:

2. Limitation of liability

The provider does not guarantee:

The accuracy, completeness, or timeliness of the information provided
The availability of the app (24/7 operation)
The accuracy of the software
The accuracy of risk assessments
The correctness of weather, pollen, or air quality data

2.2 Exclusion of liability

The provider is not liable for damages resulting from the use or non-use of the app, in particular for:

Damage to health due to incorrect interpretation of symptoms
Delays in medical care

Technical failures or data loss
Incorrect medication intake based on app data
Damage caused by third-party services (weather APIs, etc.)

Exceptions:

3. External data sources

3.1 Weather and pollen data

The app uses external services for weather, pollen, and air quality data:

Open-Meteo: Weather & air quality data
German Weather Service (DWD): Pollen forecasts

The provider has no influence on the accuracy, completeness, or timeliness of this data and accepts no liability for it.

3.2 Location data

The accuracy of location-based warnings depends on the GPS accuracy of your device. Incorrect location data can lead to incorrect risk assessments.

4. AI and algorithms

4.1 Learning algorithms

The app uses algorithms for trigger detection and risk assessment. These algorithms:

Are not perfect and can make mistakes
Are based on statistical models
Do not replace a medical diagnosis
May overlook individual characteristics

Important:

Do not rely solely on automatic risk assessments. Observe your child closely and consult a doctor if you are unsure.

5. Medication

5.1 Medication tracking

The medication tracking function is for documentation purposes only. It does not replace:

The doctor's prescription
Advice from a pharmacist
The medication package insert
Regular medical checkups

5.2 No dosage recommendations

The app does not provide dosage recommendations. Always follow the doctor's instructions and the package insert.

6. Data security

6.1 Technical failures

Despite all security measures, technical failures can occur:

Data loss due to server problems
Synchronization errors
Network failures

7.1 Parental supervision

Children under the age of 16 should use the app under parental supervision. Parents are responsible for:

Interpreting the data

Monitoring the state of health

8. Changes and updates

The app is continuously being developed. Updates may:

Add new features
Change existing features
Fix bugs
Change the behavior of the app

The provider is not liable for problems caused by updates.
