1. Scope

These General Terms and Conditions of Use (hereinafter referred to as "GTC") govern the use of the mobile application "AsthmaCare" (hereinafter referred to as 'App') from westflügelmedia, owner Marcel Volkmann (hereinafter referred to as "Provider").

By installing and using the App, you agree to these GTC. If you do not agree to the GTC, you may not use the App.

2. Description of services

2.1 Scope of functions

AsthmaCare is a mobile application designed to assist in monitoring asthma symptoms in children. The app offers the following functions:

Recording and documentation of asthma symptoms
Personalized risk assessment based on weather, pollen, and air quality
Medication tracking
Family access for multiple caregivers
Symptom diary and history display

2.2 Availability

The provider endeavors to ensure the highest possible availability of the app. However, there is no guarantee of uninterrupted availability. Maintenance work, technical malfunctions, or force majeure may lead to temporary restrictions.

The app is a documentation tool and does not replace medical advice, diagnosis, or treatment. The app is not a certified medical device and is for informational purposes only.

In an emergency, seek immediate medical help or call emergency services.

3. Conditions of use

3.1 Minimum age

Use of the app is only permitted for persons aged 16 and over. Children under the age of 16 may only use the app with the consent and under the supervision of their parents or legal guardians.

3.2 Registration

Registration with a valid email address is required to use the app. You agree to provide truthful information and to keep your login details confidential.

3.3 Technical requirements

Compatible smartphone or tablet (iOS 13+ or Android 8+)
Internet connection for synchronization and weather data
Sufficient storage space

4. Rights of use

4.1 License

The provider grants you a non-exclusive, non-transferable, revocable right to use the app for private, non-commercial purposes.

4.2 Prohibited use

The following actions are prohibited:

Reverse engineering, decompiling, or disassembling the app
Removing copyright notices or other protective notices
Commercial use without written permission
Automated queries or scraping
Distribution of malware

5. User obligations

5.1 Duty of care

You agree to:

Provide truthful and complete information
Keep your access data confidential
Inform the provider immediately if your account has been compromised
Not to misuse the app

5.2 Personal responsibility

You are responsible for checking the data recorded in the app and consulting a doctor if you have any health problems. The app is not a substitute for professional medical advice.

6. Data protection

Personal data is processed in accordance with our privacy policy. By using the app, you consent to data processing in accordance with the privacy policy.

Sensitive health data

The app processes health data (Art. 9 GDPR). This data is used exclusively for the functionality of the app and is not passed on to third parties.

7. Liability

7.1 Limitation of liability

The provider is liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, limb, or health.

In cases of slight negligence, the provider is only liable for breaches of essential contractual obligations (cardinal obligations). In this case, liability is limited to the foreseeable damage typical for this type of contract.

7.2 Medical disclaimer

⚠️ Important

The provider accepts no liability for:

Misinterpretation of symptoms or risk assessments
Delays in symptom recording
Technical errors or failures of the app
Damage to health due to non-compliance with medical recommendations

The app is not a substitute for medical treatment. In an emergency, call 112.

7.3 External services

The app uses external services (weather APIs, pollen data). The provider is not liable for the accuracy, completeness, or timeliness of this data.

8. Costs and payment

8.1 Free use

The basic functions of the app are currently available free of charge. The provider reserves the right to offer premium features for a fee in the future.

8.2 Price changes

You will be informed in good time if paid features are introduced. Existing users will be granted a transition period.

9. Term and termination

9.1 Contract term

The user agreement is concluded for an indefinite period and can be terminated by either party at any time without notice.

9.2 Termination by the user

You can terminate your account at any time in the app under "Settings → Delete account." After deletion, all your data will be irrevocably deleted.

9.3 Termination by the provider

The provider may terminate the contract extraordinarily if:

You violate these Terms and Conditions
You misuse the app
Legal or technical reasons require it

10. Changes to the Terms and Conditions

The provider reserves the right to change these Terms and Conditions at any time. You will be informed of any significant changes by email or in the app. If you do not object to the changes within 4 weeks of notification, they shall be deemed accepted.

11. Final provisions

11.1 Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

11.2 Place of jurisdiction

The place of jurisdiction for all disputes is, to the extent permitted by law, the registered office of the provider.

11.3 Severability clause

Should individual provisions of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.
